General Terms and Conditions (GTC) – Wolino GmbH

1. Scope

These general terms and conditions (GTC) apply to all business relationships between Wolino GmbH and its customers. Deviating conditions are only valid if confirmed in writing. Our terms and conditions apply exclusively.

2. Customers and Offers

Our offers are directed at businesses, craftsmen, traders, and private individuals. Prices are shown with or without VAT depending on registration. All offers are non-binding and subject to availability and possible pricing errors. Orders in non-household quantities may be rejected without justification.

3. Prices

The prices at the time of the order apply. Previous prices lose their validity when new offers are published. Price changes are reserved. Items already paid for but no longer available will be fully credited or refunded.

4. Payment

Payment can be made in advance, by credit card, TWINT, PostFinance, Swissbilling or on invoice (subject to a positive credit check). Invoices must be paid within 14 days net from the invoice date. Reminder fees and interest on arrears will be charged in the event of late payment. Invoices are sent digitally, postal delivery costs an additional CHF 2.

CembraPay

Purchase on account (including installment payments) is handled by CembraPay AG. The terms and conditions and privacy policy of CembraPay AG apply.

5. Shipping and Delivery

Delivery is made within Switzerland via parcel service or freight carrier. From an order value of CHF 250 (excluding express delivery), we deliver free of shipping costs. The delivery address must be accessible by truck. Additional costs for a second delivery, pallet returns, or difficult delivery conditions shall be borne by the customer. Risk passes to the buyer when the goods leave our warehouse.

6. Special Shipping and Hazardous Goods

Items over 30 kg, hazardous goods (e.g., methanol), or gas cylinders are only delivered by special transport. Shipping costs for such deliveries are offered individually and must be paid in advance.

7. Delivery Times

Delivery times depend on availability and are non-binding. Production or supply bottlenecks may cause delays. Delivery will be made as a complete shipment if possible.

8. Inspection upon Delivery

The customer is obliged to check the goods for transport damage upon receipt in the presence of the delivery person. Obvious damage must be noted on the delivery note and countersigned by the delivery person. Only under these conditions can complaints be considered.

9. Complaints and Warranty

Obvious defects, incorrect deliveries, or missing items must be reported in writing within 5 days. In the case of justified defects, a repair, replacement delivery, or refund will be provided. Further claims, especially for consequential damages, are excluded.

10. Returns

Returns are possible within 14 days of receipt, provided the goods are unused, in their original packaging, and complete. Excluded are: custom-made products, hygiene articles, opened software, mounted or incomplete products, and items outside our standard range. The return must be registered using our form. Return shipping costs are borne by the customer. A deduction of at least 10% will be applied for damaged packaging or missing parts.

11. Warranty Conditions

We recommend having spare parts installed only by qualified personnel. In the case of improper self-installation, the warranty expires. A bring-in warranty of 2 years applies to material and manufacturing defects. Wear parts are excluded. Return shipping costs are borne by the buyer. Warranty services are processed via our warranty system.

12. Liability

Wolino GmbH's liability is limited to intent and gross negligence. No liability is accepted for consequential damage, indirect damage, lost profit, or for improper installation or use of unsuitable accessories.

13. Data Protection

Personal data is used exclusively for processing the business relationship and is not passed on to third parties, unless required by law. The provisions of the Swiss Data Protection Act (DPA) apply.

14. Intellectual Property

Texts, images, and content on our websites are protected by copyright. Any use beyond the agreed purpose requires our express consent.

15. Special Agreements

Verbal or telephone commitments are non-binding and require written confirmation.

16. Partial Invalidity

If individual provisions of these GTC are ineffective, the validity of the remaining provisions shall remain unaffected.

17. Jurisdiction

The place of jurisdiction for all disputes is the registered office of Wolino GmbH. Swiss law exclusively applies.
